Anti-Spam Policy

Spam is absolutely not allowed and prohibited by Pangea . Any member found to be using Email for SPAM will suffer immediate loss of ability, and permission, to use the company’s product. Pangea , developer and provider of the Pangea system suite of email and mobile SMS marketing tools, along with Pangea associates and affiliates who make Pangea system available to their customers, support ONLY permission-based email and mobile marketing practices. To take into concern, Pangea has implemented some of the strictest policies in the email industry and supporting procedures to help prevented the Pangea system from being abuse for unsolicited email or SMS campaigns. Furthermore, as respond to all complaints suggesting the Pangea system has been used as a tool to send unsolicited email or SMS messages.

To prevent that, Pangea actively monitors import lists and outgoing emails and SMS messages for suspiciously large intended or actual broadcasts.

What is Spam?

Spam is unsolicited commercial email, mobile messages (e.g., SMS), junk mail or bulk mail that has not been requested by the recipient. In addition to wasting valuable time and resources, it is irrelevant and often offensive; typically, spam messages do not contain an option to unsubscribe from the mailing list. Spam can be described as the opposite of permission-based marketing. If you as a user send an email out through Pangea that generates a spam complaint, you will be charged and responsible for providing an opt-in record for the complaint at issue.

Preventing Unsolicited Emails via Pangea system

Users of the Pangea system must tolerate by a strictly enforced End User License Agreement. Under this agreement, the user has to promises not to abuse the Pangea system or to send spam. User specifically agrees not to send unsolicited bulk email or SMS messages, for commercial or non-commercial purposes. The agreement also includes such provisions as:

User agrees not to post, upload or otherwise transmit.

● All contents which are related to inappropriate subject matters;

● All content to “rented” or “purchased” lists;

● All content that is unlawful, harassing, threatening, harmful abusive, tortious, defamatory, vulgar, obscene;

● libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

● All content that you do not have any right to post and transmit under any law or contractual;

● All content, such that uploading, or transmission constitutes the infringement of any patent;

● All trademarks, copyright, trade secret or other proprietary rights of any party;

● All materials who will contain software viruses or any other computer code, files or programs designed to destroy, interrupt or limit the functionality of any computer equipment;

● All materials who will make an unreasonable large load on the company infrastructure;

● All content that intentionally or unintentionally violates any applicable local, state, national or international law.

● All content that is misleading or impersonates any person or entity or falsely states or otherwise misrepresents your affiliation with a person or entity;

● All content with manipulated, or forged identifiers;

●All content promoting harm or providing instructional information about illegal activities;

All users of Pangea have to accept that an unsubscribe option will be automatically appended to every email sent to more than 100 people via the Pangea system. This is mandatory. This means that when the unsubscribe option is requested by an email recipient. Pangea system automatically suppresses emails to that email address in future campaigns. This feature is also mandatory.

If an Pangea system user violates Pangea usage rules, or for any other, reason deemed appropriate by Pangea , Pangea reserves the right to suspend or terminate these users, without notice, access to the Pangea system User’s account and all related data.

Permission-Based Marketing

Pangea offers free tools like confirmed opt-in subscription forms to encourage Pangea system users to manage and create confirmed opt-in lists of contacts. That means that by building and using confirmed opt-in lists, Pangea system users can be certain that they are sending emails to recipients who have expressly given their permission, and requested, to receive such emails. However, if Pangea System User desires to allow people to subscribe to any of their email lists on the Pangea system, they are required to use Pangea confirmed opt-in subscription form for an opt in email.

It recommended Action — Unsolicited Email Complaints.

It is possible for people who have subscribed to your mailings to forget they have granted you permission. If a complaint is received by Pangea regarding alleged unsolicited emails being sent from the Pangea system tools of opt in email, an immediate investigation is undertaken.

Warning

The Pangea system user is notified that an unsolicited email complaint has been lodged against them, and a demand is issued to “show proof” that the complainant opted into the User’s list. The User is reminded of the terms they accepted and in addition. The complainant’s email address is automatically tagged as “unsubscribed” if the complainant did unsubscribe so no further emails are sent to the complainant. The User is also required to manually remove the complainant’s email address from their contact list of opt in email if the complainant did not unsubscribe.

Termination

If Pangea has ANY reason to believe the User of the opt in email, despite the warnings, is or will continue to send unsolicited bulk email to individuals without their permission, or any complainant that has previously unsubscribed. The User’s Pangea account privileges are subject to immediate termination.

Pangea and Pangea partners take permission marketing very seriously. Often, many spam complaints are registered with anti-spam agencies. The company fully supported the efforts of agencies working to responsibly curtail the sending of unsolicited commercial email. It should be taking to concern that if an individual opted-in to receive an Pangea and then falsely and/or maliciously files a spam complaint against Pangea , the company will cooperate fully with appropriate agencies to ban the user from a further use of anti-spam software and community.
